In 1690 a Latin translation of a philosophical treatise, originally written in English by Anne Conway , was published anonymously. The English manuscript did not survive, but in 1692 the Latin version of Conway's text was translated (...) into English as The Principles of the Most Ancient and Modern Philosophy. Conway was widely known by seventeenth-century philosophers and religious writers, including the Cambridge Platonist, Henry More; Descartes's correspondent, Princess Elisabeth of Bohemia; Robert Boyle; physician and vitalist philosopher, Francis Mercury van Helmont; as well as numerous Quaker leaders. And her Principles were read with critical approbation by such figures as Leibniz. Further, Conway's text is probably the most anthologized of the writings of seventeenth-century women philosophers. It is curious, then, to discover a dearth of critical literature on the Principles. When Peter Loptson produced the first modern edition of the Principles , he attempted to interest contemporary philosophers in Conway's essentialist metaphysics. Bryant’s paper, "A Logic of Multiplicities: Deleuze, Immanence, and Onticology," is useful for showing how the historical legacy of hierarchy in its many philosophical forms is still present, important, and, in fact, required even by those such as Bryant who would seek to deconstruct or ignore it. The following response will discuss Bryant’s presentation of his alternative position and throughout point out: a) the straw-man versions of hierarchy that Bryant employs; b) why what Bryant claims to be inherent negatively in (...) hierarchy is not the case; c) how Bryant’s position actually relies upon hierarchy for its own explication, and finally; d) the various principles of hierarchical metaphysics that are required in order to make sense of experience and reality. These latter include the notions that i) there are many kinds of hierarchy; ii) Being and Unity are prior to Multiplicity; iii) relation without substance is incoherent; iv) hierarchy is not inherently tyrannical; v) the distinction between essentially and accidentally ordered causal series is a real and useful one; and vi) the existence of hierarchy is more self evident than is flat ontology. ABSTRACT The UK Supreme Court ruling of Montgomery v Lanarkshire clarified that in obtaining informed consent to treatment, practitioners are under a duty to inform patients of material risks. Traditionally such risk has pertained to the clinical risks inherent to treatment. In examining empirical and judicial evidence, this paper makes the case for disclosure of potent financial interests; with potency relating to those interests likely to have greatest influence over practice. The paper explores how financial interests may detrimentally influence practice (...) patterns and how non-disclosure of such interests may be linked to the erosion of patient trust and subsequent disinclination to consent to treatment. Judicial notions of material risk are explored, and the conclusion reached that they offer a broader interpretation of disclosable risk compared to current UK GMC guidance. It is anticipated that empirical evidence could be used by the courts in determining questions of both materiality and causation in cases of negligent non-disclosure of potent financial interests. The paper concludes that there is sufficient reason to surmise that a test case could successfully apply the principles identified therein to establish the materiality of conflict of interest in informed consent to medical treatment. Henry Sidgwick consists of papers by Stefan Collini, John Skorupski, and Ross Harrison, with replies by Jonathan Rée, Onora O'Neill, and Roger Crisp.Collini's rich and witty paper considers two pictures of Victorian (...) intellectuals—the "public moralist," such as John Stuart Mill, and the academic specialist. Sidgwick in the 1880s and 1890s does not fit comfortably into either camp. He champions the academic philosopher over Leslie Stephen or Mathew Arnold; he contributes to Mind rather than writing to newspapers or standing for parliament; he refuses to take a public stand on the Boer war despite opposing it. He would not have been a teledon. But he also exerts influence on university policies (founding Newnham College for women, opposing the Latin and Greek requirement for admission), through Royal Commissions, and through his personal connections to those in power. (He had as brothers-in-law the Prime Minister and the Archbishop of Canterbury.) He represents one solution to the new problem of combining academic specialization with practical concerns. [End Page 569]One quibble: Collini argues that Sidgwick wields his analytic method in order to end public debate; disagreements rest on conceptual confusions. But Sidgwick's late essays do not close with "a thin, dry question to which... the answer is more or less obvious," but with controversial proposals (44): to prevent war, individual cultivation of impartiality is more important than external arbitration; there are no significant differences between moral requirements on states and individuals; the unequal distribution of luxuries is morally defensible if and only if necessary for "aesthetic progress"; sociology is suspect and must be kept distinct from ethics. A second paper on clerical veracity is needed given controversy about the first.Harrison's slightly diffuse paper places Sidgwick in the utilitarian tradition of discussing sanctions for morality. (Crisp argues neatly that Bentham and Mill are closer to Sidgwick than Harrison allows.) Harrison closes by arguing that Sidgwick should not have been bothered by the dualism of practical reason—the view that utilitarianism and egoism conflict and that there are no decisive arguments for choosing between them. He should have ended the Methods with utilitarianism. The conflict between egoism and utilitarianism "should not matter" because "these are truths of practical rather than speculative reason." Conflict shows only that "we are not in the best of all possible worlds" (114). This helps if, with Harrison, Sidgwick's worry is the "theoretical" one that rival properties claim to be right-making (110). But Sidgwick sees the problem as practical: when egoism and utilitarianism conflict, I must decide which to follow.Skorupski also rejects the dualism. There are many true underived claims about reasons for action. Each can be seen as an instance of the "Feeling/Disposition Principle" (F): "If there's a reason to feel f there's reason to do what feeling f characteristically disposes one to do" (74). For example, if there is a reason to feel gratitude, there is a reason to express this gratitude. Egoistic reasons are the products of F when desire is the feeling. Any impartial theory, because it goes beyond the feelings of a particular individual in a particular situation, cannot be a case of F and so counts as a principle of practical reason. True claims about reasons for action are either many or, if restricted to practical reason, one. (Skorupski adds that an impartial theory, since indefeasible, trumps egoism. For example, my reason to express gratitude is defeated by noting that general good is not served by expressing gratitude, but need not be defeated by noting that my own good is not served. This, however, seems mere assertion. Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

Returning genomic research results to family members raises complex questions. Genomic research on life-limiting conditions such as cancer, and research involving storage and reanalysis of data and specimens long into the future, makes these questions pressing. This author group, funded by an NIH grant, published consensus recommendations presenting a framework. This follow-up paper offers concrete guidance and tools for implementation. The group collected and analyzed relevant documents and guidance, including tools from the Clinical Sequencing Exploratory Research Consortium. The authors then (...) negotiated a consensus toolkit of processes and documents. That toolkit offers sample consent and notification documents plus decision flow-charts to address return of results to family of living and deceased participants, in adult and pediatric research. Much recent work on Kant's argument that the Categorical Imperative is the fundamental principle of morality has focused on the gap in that argument between the conclusion that rational agents conform to laws that apply to every rational agent, and the requirement contained in the Universal Law of Nature formula.1 While it seems plausible – even trivial– that a rational agent, insofar as she is a rational agent, conforms to whatever laws there are that are valid for all rational agents, (...) there does not appear to be any obvious route from this seemingly trivial claim to the controversial and substantive principle of acting only on maxims that one can at the same time rationally will every rational agent to act on.2 In what follows, I argue that the connection between rational agency and mere conformity to universally valid laws is not as trivial as it may seem. Many readers, I suspect, assume that Kant makes the trivial claim about rational agency because rational agency is rational, and being rational requires conforming to those laws that apply to all rational beings. For instance, this assumption is implicit in Onora O'Neill claim that "the interest of a Kantian universality test is that it aims to ground an ethical theory on notions of consistency and rationality rather than upon considerations of desire and preference."3 But, as I contend in what follows, the requirement to conform to laws valid for all rational agents is based on the fact that rational agency is, not rational, but agency. Indeed, the arguments leading to the first formulation of the Categorical Imperative rely on the idea of rational willing as a kind of causation in order to show this. And, as it turns out, the claim that the concept of causation contains the idea of conformity to universally valid laws is not a trivial claim. (shrink)

Christopher Hookway has been influential in promoting engagement with pragmatist and naturalist perspectives from classical and contemporary American philosophy. This book reflects on Hookway’s work on the American philosophical tradition and its significance for contemporary discussions of the understanding of mind, meaning, knowledge, and value. -/- Hookway’s original and extensive studies of Charles S. A stable classification of practical principles into mutually exclusive types is foundational to Kant’s moral theory. Yet, other than a few brief hints on the distinction between maxims and laws, he does not provide any elaborate discussion on the classification and the types of practical principles in his works. This has led Onora O’Neill and Lewis Beck to reinterpret Kant’s classification of practical principles in a way that would clarify the conceptual connection between maxims and laws. In this paper I (...) argue that the revised interpretations of O’Neill and Beck stem from a mistaken reading of the fundamental basis of the classification of practical principles. To show this, I first argue that Kant distinguishes between maxims and laws on the bases of validity and reality. I then argue that although a practical principle necessarily has the feature of validity, its reality in actually moving the agents to action sufficiently makes a principle a practical principle. If this is so, I argue that the classification of practical principles must be based on the extent to which they are effective in human agents. Such a classification yields us three exhaustive and mutually exclusive types namely, “maxims that are not potential laws”, “maxims that are potential laws” and “laws that are not maxims”. (shrink)

Is there a relation between the increasing extension of markets and market norms to previously non-market goods, and the growth of environmental problems? This chapter explores two competing answers: market-endorsing positions that argue that a source of environmental problems lies in the absence of markets in environmental goods and that the extension of markets or market modes of valuation to environmental goods offers the most effective way of protecting them; market-skeptical positions that deny that the extension of markets will protect (...) environmental goods or more strongly that markets and increasing marketization are themselves a source of environmental problems. These positions offer distinct perspectives on market mimicking instruments in environmental policy making, such as cost-benefit analysis, and on the development of new markets, for example in emission rights and biodiversity offsets. The issues raised include questions about value commensurability, justice, epistemic limits to planning and markets, and environmental limits to growth. (shrink)

Peter Lombard lamented the abandonment of Augustine’s position affirming the materiality of demons and the demonic body, since by his time (some 700 years after Augustine), under the influence of the Pseudo-Dionysius, it was generally agreed within the Christian tradition that demons (and angels) are intelligible, disembodied substances. The principles that the cosmos is spatially and materially divided and stratified and that demons share ontologically in the nature of the part that they inhabit allowed figures such as Apuleius, Porphyry, and (...) Augustine to account for various aspects of demonic nature and activity that seemed to follow from reason, revelation, and practical experience. The material body of the demon and its relation to the pneuma, or vehicle of the soul, is often invoked to explain demonic agency and the extent of demonic knowledge and to distinguish between evil and good demons (or angels). The following paper weighs in on and clarifies Augustine’s demonic ontology. Although scholars generally recognise Augustine’s position maintaining that demons possess aerial bodies, nevertheless, the ambiguity surrounding Augustine’s opinion, attested to even by Peter Lombard, is overlooked, and Augustine’s conviction is often taken for granted and supported by citing the prominent City of God, the very work in which Augustine’s own views are suspect. This paper provides support to the assessment of Augustine’s doctrine of the demonic body by examining his cosmology, particularly his spatial and elemental division of the cosmos, and exhibits his adherence to the spatio-material principle according to which a creature’s bodily constitution is cognate with the elemental composition of the physical stratum of the cosmos in which they dwell. The paper concludes by indicating how Augustine’s explanations of demonic agency, far from being ambiguous on the nature of the demonic body, are in fact premised on their aerial corporeality, thereby demonstrating more definitively his conviction that demons possess material bodies. This article makes the case for a specific variety of what we call Collective Capital Institutions (CCIs), by returning to the idea of Wage-Earner Funds (WEFs) – a 1970s Swedish policy proposal designed gradually to shift ownership and control over parts of the economy to democratically controlled institutions. We identify two attractive rationales in favour of such a scheme and argue that both can fruitfully be transposed to the current worldwide economic situation. The egalitarian rationale is that WEFs could help (...) in the pursuit of equality by giving a wider set of people a stake in collectively owned companies and a right to their profits. The democratic rationale is that WEFs redistribute not only these profits, but also the power over economic decisions made within companies. We then contrast such schemes for collective capital ownership with the similar but much more privatised proposals set out in, for instance, John Rawls's idea of a ‘property-owning democracy’. We argue that CCIs ultimately are more likely to contribute to the development of the ‘sense of justice’ within society that is needed for a stable just society. We conclude that CCIs deserve a great deal more exploration in academic and political discussions of egalitarian economic systems. (shrink)
